Payment of Invoices/Late Payment Charges

  1. A minimum charge of $75.00 for each file applies.
  2. Payments for invoices are due within 15 days of Invoice Date.
  3. Locates on the 1-15th are invoiced on the 16th of the month. Payment due 1st of the following month. Locates from the 16-30th or(31st) are invoiced on the 1st of the month. Payments due on the 15th of the following month.
  4. The Date of the Locate is deemed to be the date the locate information is sent to the customer.
  5. Payments are by Electronic Funds Transfer to [email protected].
  6. Late Payment Charge – $50 late payment charge for each file not paid when due.
  7. File Handling – Cancelation Fees:
    1. If a customer cancels the Search Request the minimum charge ($75) still applies.
    2. Customer agrees to provide ProTracers with an exclusive handling period for the time corresponding to the Search Request. For example: If a client requests a 30-day search then the exclusive handling period is 30 days. If the Customer requests a 10-day search, then the exclusive handling period is 10 days.
    3. During this exclusive 10- day listing period, the customer agrees that ProTracers is the sole tracing company working on the file including agreement that the customer themselves, are not tracing the file.

Locate Details

  1. Confirmation of the same information provided by the client for Residential address or Place of Employment or Address for Service is considered Located.We cannot control where subjects live or where they work.
  1. Files located with Residential, or Employment addresses in the United States are considered International and are billed an additional $100.
  1. If a subject is Deceased or Incarcerated, it is still considered a locate. Obituary or online confirmation provided.
  1. Place of Employment
    1. Unemployed – with Residential Address is considered a locate.
    2. Self Employed – with address of business is considered a locate.
    3. Bankruptcy- with Trustee details is considered a locate.
  1. Residential Address/ Address for Service
    1. Best efforts to provide a Telephone number for the subject will be undertaken, but we do not guarantee a phone number.

Locate Guarantee /Refunds/Re-Trace               

  1. ProTracers guarantees the information we provide to be correct on the date of locate.
  1. In the unlikely event that the customer finds the locate information to be in dispute. ProTracers will retrace the file to reverify the information or provide updated new information or refund the fees paid for the file within 10 business days of dispute notification.
  1. The Customer must advise of any disputed information within 30 days of receiving the locate report.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event will ProTracersr its directors, officers, employees or agents be liable to any person for any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost, revenue, sales, impact on business, business interruption, however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise.

Acceptable Use

You are only to use the information provided by ProTracers for the reason stated in the Search Request.

Prohibited Use

You are prohibited from using the information provided by ProTracers:

(a) for any unlawful purpose.

(b) to solicit others to perform or participate in any unlawful acts.

(c) to violate any international, federal, provincial or state regulations, rules, and laws,

(d) to harass, insult, defame, intimidate, slander, abuse, or do harm, to any individual or entity

Severability

All rights and restrictions contained in this Agreement shall be applicable and binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid or unenforceable. If any provision or portion of any provision of this Agreement shall be held to be illegal, invalid or unenforceable by a court or jurisdiction, the remaining provisions or portions shall remain in full force and effect.

Changes and Amendments

ProTracers reserves the right to update and these Terms and Conditions.

Indemnification

You agree to indemnify and hold ProTracers directors, officers, employees and agents, harmless from and against any liabilities, losses, damages or costs, including attorneys’ fees, incurred in connection with or arising from any third- party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your, your use of the information provided by ProTracers.
